For the court to render this decision, what evidence do they have at their disposal that is greater than the information in the hands of the President, with the full force of the government behind his knowledge? The appeals court is disqualified on the face of it, as its ruling was highly steeped in bias and political overtones.

And that's exactly why this gets overturned. This law has been on the books for more than two centuries, and in all that time the courts have held that the determination is an executive function not subject to review unless there's evidence that it wasn't made in good faith.

So the correct answer, should anyone think this is overreach, is to amend the law. And that's for Congress to decide, not the courts.
